class=SpellE>officio</span></i> da Unidade sediada em Boa Viagem para a Unidade
localizada no Município do Rio de Janeiro. <span
class=GramE> <span style='font-family:"Times New Roman","serif";font-weight:
normal'><o:p></o:p></span></span></span></strong></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>Por conta do seu deslocamento e da
necessidade de dar continuidade aos estudos na Cidade do Rio de Janeiro, o
militar solicitou à Sub-reitoria de Graduação da UERJ, transferência do curso
de Direito da referida Universidade Particular para o mesmo curso na
Universidade do Estado do Rio de Janeiro, com base na Lei n° 9.536/97.</span></strong></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>O pedido do militar foi indeferido
pela Sub-reitora da UERJ, com fulcro no ato normativo interno desta
Universidade (Deliberação n° 28/2000), o qual regula esta matéria, uma vez que
a Universidade de origem do militar era uma instituição de ensino superior
particular.</span></strong><span style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>O militar impetra mandado de segurança
alegando, em sua defesa, os seguintes argumentos:</span></strong><span
style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>I - que o seu direito está amparado
pelo parágrafo único do artigo 49 da Lei Federal n° 9536/97 – dispositivo este
que regulamenta o parágrafo único da Lei Federal n° 9.394/96 (estabelece as
diretrizes e bases da educação nacional);</span></strong><span
style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>II - que a norma restritiva do art. 99
da Lei 8.112/90 (entidades congêneres) não se aplica aos militares;</span></strong><span

style='font-family:"Arial","sans-serif"'>III - que o ato normativo n° 28/2000,
no qual o sub-reitor se baseou para indeferir o pedido de transferência, “tem
vício de ilegalidade a negativa de matrícula”, pois contraria o conteúdo da Lei
nº 9536/97, uma vez que a Lei federal não exige o caráter congênere entre
instituições de ensino;</span></strong><span style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>

style='font-family:"Arial","sans-serif"'>Diante da situação acima descrita,
questiona-se: qual a interpretação constitucional mais adequada para a solução

correlacionar todos os dispositivos normativos da norma, assim só conseguiremos
elucidar a interpretação a partir do conhecimento do todo. Hans Kelsen tem a
visão do sistema jurídico que seria naturalmente uma pirâmide normativa, na
qual temos no topo a Constituição, abaixo vêm a legislação, logo abaixo os atos
administrativos, e posteriormente os contratos e decisões.<o:p></o:p></span></strong></p>

no Diário Oficial do Estado de concurso público para o preenchimento de vagas
para o cargo de policial. Uma das provas é a realização de testes físicos e um
dos testes exige que os candidatos façam a seguinte atividade: “Flexões

style='font-family:"Arial","sans-serif"'>Em função da redação incoerente do
texto desse teste, o Estado publicou uma errata do edital no mesmo órgão
oficial de imprensa, duas semanas antes de iniciarem as provas, com a seguinte
redação: “Flexões abdominais: consiste em o candidato executar exercícios
abdominais, por flexão de tronco, em decúbito dorsal em um maior número de
repetições tocando os cotovelos nos joelhos ou coxas, no período de um minuto.<span

inscrito na prova no momento da percepção do equívoco da referida redação,
muitos deles se consideraram surpreendidos, no dia da realização desse teste
físico, pois não tomaram conhecimento da errata do edital.</span></strong><span
style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>Alguns desses, que não conseguiram
passar na prova de esforço físico, ingressaram com mandado de segurança com a
alegação de que esse teste deve ser desconsiderado como critério de aprovação,
pois foi incluído após as inscrições, apenas duas semanas antes do começo das
provas e porque não foi publicado num jornal de grande circulação para que
todos tivessem a chance de tomar conhecimento da modificação. Assim, alegam que
houve ofensa ao princípio da razoabilidade.</span></strong><span
style='font-family:"Arial","sans-serif"'><o:p></o:p></span></p>
<p class=western style='margin-bottom:9.9pt;line-height:150%;background:#EFEFEF'><strong><span
style='font-family:"Arial","sans-serif"'>A quem assiste razão no caso? Dê os
fundamentos jurídicos cabíveis (fundamentos normativos, jurisprudenciais e
doutrinários).</span><o:p></o:p></strong></p>

style='mso-spacerun:yes'> </span>Segundo entendimento jurisprudencial da
Segunda Turma do STF através do Recurso Extraordinário 390.939-8 Maranhão,
neste caso cabe razão ao estado, sob os fundamentos de que a alteração no
edital do concurso ocorreu para sanar erro material e foi publicada antes da
realização da prova física no Diário Oficial do Estado, sendo desnecessária a
sua veiculação em jornal de grande circulação, pois a divulgação no DOU é
suficiente para se der publicidade de um ato administrativo, e pode a
administração, a qualquer tempo, corrigir seus atos, sendo que no presente caso
garantiu aos candidatos prazo razoável para o conhecimento prévio do exercício
a ser realizado, entendeu ainda que a retificação atingiu indistintamente todos
os candidatos.<span style='mso-spacerun:yes'> </span><o:p></o:p></span></strong></p>

de lei Nº 6.944: A alteração de qualquer dispositivo do edital deverá ser publicada
no Diário Oficial da União e divulgada na forma do disposto no inciso II.<span

administração é livre para estabelecer as bases do concurso e os critérios de
julgamento, desde que faça com igualdade para todos os candidatos, tendo,
ainda, o poder de, a todo tempo, alterar as condições e requisitos de admissão
dos concorrentes, para melhor atendimento do interesse público. Não obstante, a
exclusão ou aprovação com base em critério subjetivo, como a avaliação sigilosa
de conduta do candidato, é ilegal se ocorrer sem motivação disse Hely Lopes
Meirelles em seu curso de Direito Administrativo Brasileiro – pagina 405, in <span
