e vários colegas alugaram uma casa e contrataram Helena, responsável pela
limpeza casa, além de cozinhar para os estudantes moradores. Analisando a
situação concreta apresentada responda aos seguintes questionamentos:<span

a)</span> Abigail e Helena possuem relação de emprego com o Pensionato e os
alunos da residência respectivamente? Justifique.<span class=GramE><br>

que trabalha no pensionato de Gabriela, não é doméstica, tendo em vista a finalidade
lucrativa da atividade desenvolvida pela empregadora. Helena, por sua vez, é
doméstica, pois trabalha em uma república de estudantes, em atividades de mero
consumo por parte dos tomadores de serviço (limpeza do local e preparo das
refeições para os estudantes moradores da república). <o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-size:10.0pt;
font-family:"Verdana","sans-serif"'>“A lei refere-se à pessoa ou família.
Contudo, evidentemente que certo grupo unitário de pessoas físicas, atuando
estritamente em função de interesses individuais de consumo pessoal, pode
também tomar trabalho doméstico, nos moldes da Lei n. 5.859/72. É o que se
passa, por exemplo, com uma informal república estudantil e sua
faxineira/cozinheira (caso que não se confunde, por óbvio, com o pensionato, em
que alguém explora a oferta ao mercado de serviços de moradia e alimentação). <o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-size:10.0pt;
font-family:"Verdana","sans-serif"'>“O serviço doméstico pode ser prestado <span
class=GramE>a</span> pessoa que reside só, a família ou até mesmo a pessoas que
se reúnem para viver comunitariamente, como em uma república de estudantes, por
exemplo, onde não se explora qualquer atividade lucrativa. <o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-size:10.0pt;
font-family:"Verdana","sans-serif"'><span style='mso-spacerun:yes'> </span>“O
trabalho prestado para um grupo de pessoas que se reúne de forma espontânea e
coabitam no mesmo local, cujo serviço se destina ao consumo pessoal de cada
membro do grupo, sem natureza lucrativa, pode tomar a forma de relação
doméstica, desde que caracterizados os requisitos contidos na Lei nº 5.859/72.
Tal situação pode ocorrer na informal república estudantil, com uma faxineira
ou cozinheira contratada para trabalhar para o grupo.<o:p></o:p></span></p>
<p class=MsoNormal style='background:#EFEFEF'><span style='font-size:10.0pt;
font-family:"Verdana","sans-serif"'>Ambas possuem direito a estabilidade, pois
tanto as empregadas em geral quanto as domésticas têm direito à garantia de
emprego decorrente de gestação, respectivamente por força do art. 10, II, “b”,
