agente pratica uma conduta, da qual advém um resultado mais gravoso que o
pretendido, sendo este previsível, será responsabilizado penalmente por ambos
os resultados, ainda que não tenha assumido o risco de sua produção.</span><span

não querendo diretamente praticar a infração penal, não se abstém de agir e,
com isso, assume o risco de produzir o resultado que por ele já havia sido
