dez dias sem que José tivesse retornado ao trabalho, a empresa convocou-o por
meio de notificação, recebida por José mediante aviso de recebimento. José não
atendeu à notificação e, completados trinta dias de falta, a empresa LV expediu
edital de convocação, publicado em jornal de grande circulação, mas, ainda
assim, José não retornou ao trabalho. Preocupada com a rescisão do contrato de
trabalho, com a baixa da CTPS, com o pagamento das parcelas decorrentes e para
não incorrer em mora, a empresa procurou profissional da advocacia.
Considerando a situação hipotética acima apresentada, na qualidade de <span

reclamante, admitido em 11 de maio de 2008, prestava serviços como
recepcionista, percebendo um salário mensal de R$ 465,00.<o:p></o:p></span></p>
<p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span
style='mso-fareast-font-family:"Times New Roman"'>Ocorre que em 19 de junho de
2009, o mesmo afastou-se do trabalho em detrimento do benefício previdenciário
de auxílio doença, cujo encerramento se deu em 20 de julho de 2009.<o:p></o:p></span></p>
<p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span
style='mso-fareast-font-family:"Times New Roman"'>Passados dez dias, não tendo
José retornado ao trabalho, a empresa notificou-o, através de AR, devidamente
anexada à exordial, para que ele pudesse retornar, todavia o reclamado não
atendeu a solicitação.<o:p></o:p></span></p>
<p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span
style='mso-fareast-font-family:"Times New Roman"'>Após trinta dias e não tendo
o funcionário voltado a prestar serviços após nova tentativa de contato,
vislumbrada a necessidade de resilição contratual, com a posterior baixa da
CTPS, bem como o pagamento das parcelas decorrentes do encerramento de tal
relação jurídica, eis que restou configurada a justa causa por abandoo de
emprego, nos moldes do artigo 482, alínea i, da CLT c/c Súmula 32, do Tribunal
Superior do Trabalho, requer a Vossa Excelência, a concessão do depósito
judicial.<o:p></o:p></span></p>
<p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span
style='mso-fareast-font-family:"Times New Roman"'>Insta salientar que em razão
dos fatos expostos verifica-se que até a presente data, não foi possível
proceder à homologação da rescisão contratual, uma vez que o Consignado não
atendeu à convocação da Consignante, conforme se depreende da documentação anexada.<o:p></o:p></span></p>
