tratado, as partes comprometeram-se a garantir a preservação da qualidade da
água do Rio Danúbio e do meio ambiente vinculado <span class=GramE>a</span>
construção do sistema.<o:p></o:p></span></p>

Por conta da realização dos planos da variante C a Hungria emitiu uma nota

não-membro da União Européia (UE) celebra tratado com a República Tcheca,
membro da referida Organização, cujo objeto, dentre outros, é o desenvolvimento
econômico e social da região. No entanto, o tratado, negociado sob a condução
ardilosa de Alfa, induzindo à assinatura nas mesmas circunstâncias pelo
plenipotenciário Tcheco, é ratificado por seu chefe de Estado, que desconhecia
o ambiente das negociações e da conseqüente assinatura. Quando da execução do
Tratado, a República Tcheca percebe a existência de uma cláusula na qual o

redação de alguns dispositivos do tratado, dava sentido diverso daquele esperado
pelo plenipotenciário. Os termos foram introduzidos por Portugal, através do
seu plenipotenciário, que desconhecia a diferença lingüística apontada como
vício. Todavia, o representante, plenipotenciário da República Federativa
do Brasil tinha previamente conhecimento da questão, e mesmo assim alegou estar

XX, sempre foi regulado, <span class=GramE>via de regra</span>, pelo costume
internacional. Porém, o trabalho desenvolvido pela Comissão de Direito
Internacional das Nações Unidas, resultou na elaboração e conclusão da
Convenção de Viena sobre Direito dos Tratados, celebrada em 22 de maio de 1969,
tendo entrado em vigor em 27 de janeiro de 1980. Tal instrumento internacional
se justificava pelo fundamental papel que os tratados significaram e significam
na história das relações internacionais, bem como pela importância, cada vez
maior, dos tratados como fonte do Direito Internacional e como meio de
desenvolver a cooperação pacífica entre as Nações. Sob o prisma da Convenção de
Viena sobre Direito dos Tratados, é correto afirmar, quanto <span class=GramE>a</span>
elaboração, conclusão e entrada em vigor dos tratados internacionais, EXCETO:<o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-size:10.0pt;

<span style='background:yellow;mso-highlight:yellow'>(A) Nem todos os Estados
têm capacidade para concluir tratados.</span><o:p></o:p></span></p>

font-family:"Arial","sans-serif"'>(B) Uma pessoa é considerada representante de
um Estado para a adoção ou autenticação do texto de um tratado ou para
expressar o consentimento do Estado em obrigar-se por um tratado se apresentar
plenos poderes apropriados ou a prática dos Estados interessados ou outras
circunstâncias indicarem que a intenção do Estado era considerar essa pessoa
seu representante para esses fins e dispensar os plenos poderes.<o:p></o:p></span></p>

independentemente da apresentação de plenos poderes, são, dentre outros,

atos relativos à conclusão de um tratado.<o:p></o:p></span></p>

font-family:"Arial","sans-serif"'>(D) Um ato relativo à conclusão de um tratado
praticado por uma pessoa que, nas formas ordinárias e expressas de
representação estatal previstas pela da Convenção de Viena sobre Direito dos
Tratados, não pode ser considerada representante de um Estado para esse fim,
não produz efeitos jurídicos, a não ser que seja confirmado, posteriormente,
por esse Estado.<o:p></o:p></span></p>
