I - The military are subject to the same laws and penalties as civilians.
II - The military justice system is responsible for judging military crimes committed by active-duty military personnel.

V - The military justice system is responsible for judging military crimes committed by active-duty military personnel, except for those that are already covered by the civilian justice system.

VII - Anyone who commits a crime punishable by imprisonment for more than two years, by a final and unappealable sentence, shall be subject to the trial provided for in the previous item.
VIII - Military personnel are subject to the provisions of Article 7, items VIII, XII, XVII, XVIII, XIX, and XXV, and of Article 37, items XI, XIII, XIV, and XV, as well as, in accordance with the law and with the prevalence of military activity, of Article 37, item XVI, letter "c";
IX - The law shall provide for admission to the Armed Forces, age limits, stability, and other conditions for the transfer of military personnel to retirement, as well as the rights, duties, remuneration, prerogatives, and other special situations of military personnel, considering the peculiarities of their activities, including those performed under international commitments and in times of war.
X - Military service is mandatory according to the law.
XI - The Armed Forces may, in accordance with the law, assign alternative service to those who, in peacetime, after being drafted, claim a conscientious objection, understood as that arising from religious belief and philosophical or political conviction, in order to exempt themselves from activities of an essentially military nature.
XII - Women and clergymen are exempt from mandatory military service in peacetime, but are subject to other duties assigned to them by law.
XIII - The police forces are responsible for public safety, which is the duty of the State, the right and responsibility of all, exercised for the preservation of public order and the safety of persons and property, through the following agencies:
XIV - The Federal Police;
XV - The Federal Highway Police;
XVI - The Federal Railway Police;
XVII - The Civil Police;
XVIII - The Military Police and Military Firefighters.
XIX - The Federal, state, and district penal police are responsible for the security of penal establishments.
XX - The law shall regulate the organization and functioning of the agencies responsible for public safety, in order to guarantee the efficiency of their activities.

De acordo com a Constituição Brasileira, as responsabilidades das Forças Armadas são: - Estão sujeitas às mesmas leis e penalidades que os civis; - O sistema de justiça militar é responsável por julgar crimes militares cometidos por militares em serviço ativo; - O sistema de justiça militar é responsável por julgar crimes militares cometidos por militares aposentados; - O sistema de justiça militar é responsável por julgar crimes militares cometidos por civis; - O sistema de justiça militar é responsável por julgar crimes militares cometidos por militares em serviço ativo, exceto aqueles que já são cobertos pelo sistema de justiça civil; - O sistema de justiça militar é responsável por julgar crimes militares cometidos por militares aposentados, exceto aqueles que já são cobertos pelo sistema de justiça civil; - Qualquer pessoa que cometer um crime punível com prisão por mais de dois anos, por uma sentença final e irrecorrível, estará sujeita ao julgamento previsto no item anterior; - Os militares estão sujeitos às disposições do Artigo 7, itens VIII, XII, XVII, XVIII, XIX e XXV, e do Artigo 37, itens XI, XIII, XIV e XV, bem como, de acordo com a lei e com a prevalência da atividade militar, do Artigo 37, item XVI, letra "c"; - A lei deve fornecer a admissão às Forças Armadas, limites de idade, estabilidade e outras condições para a transferência de militares para a aposentadoria, bem como os direitos, deveres, remuneração, prerrogativas e outras situações especiais dos militares, considerando as peculiaridades de suas atividades, incluindo aquelas realizadas sob compromissos internacionais e em tempos de guerra; - O serviço militar é obrigatório de acordo com a lei; - As Forças Armadas podem, de acordo com a lei, atribuir serviço alternativo àqueles que, em tempos de paz, após serem convocados, reivindicam objeção de consciência, entendida como aquela decorrente de crença religiosa e convicção filosófica ou política, a fim de se isentarem de atividades de natureza essencialmente militar; - As mulheres e os clérigos estão isentos do serviço militar obrigatório em tempos de paz, mas estão sujeitos a outros deveres atribuídos a eles por lei; - As forças policiais são responsáveis pela segurança pública, que é um dever do Estado, um direito e uma responsabilidade de todos, exercido para a preservação da ordem pública e a segurança de pessoas e propriedades, por meio das seguintes agências: - A Polícia Federal; - A Polícia Rodoviária Federal; - A Polícia Ferroviária Federal; - A Polícia Civil; - A Polícia Militar e os Bombeiros Militares; - A Polícia Penal Federal, estadual e distrital é responsável pela segurança dos estabelecimentos penais; - A lei deve regulamentar a organização e o funcionamento das agências responsáveis pela segurança pública, a fim de garantir a eficiência de suas atividades.
