What is the concession?
It is the delegation of its provision made by the granting authority through bidding in the competition modality to a person who demonstrates capacity for its performance, at its own risk and for a determined period.
The granting authority is the Union, the State, the Federal District or the Municipality, in whose competence the public service is located.
It is possible to sub-concession, provided it is authorized, consisting of the hiring made by the concessionaire for the acquisition of services or goods directly related to the object of the concession.
Contracts between concessionaires and third parties do not involve the granting authority.
The granting authority may monitor the services, as well as intervene in the concession if necessary.
The Granting Authority may establish tariff benefits not contemplated in the concession contract, as such action stems from the very ownership of the public service. Like the concession contract, it is only the execution of the public service that is transferred to the concessionaire, and it is up to the Granting Authority to regulate the granted service (Article 2, II, and Article 29, I, both of Law 8,987 / 95).

A concessão é a delegação da prestação de um serviço público feita pela autoridade concedente através de licitação na modalidade de concorrência a uma pessoa que demonstre capacidade para sua execução, por sua conta e risco e por um período determinado. A autoridade concedente pode monitorar os serviços, bem como intervir na concessão se necessário. Contratos entre concessionárias e terceiros não envolvem a autoridade concedente. A autoridade concedente pode estabelecer benefícios tarifários não contemplados no contrato de concessão, pois tal ação decorre da própria titularidade do serviço público.
