Tortura para a prática de crime ou tortura-crime: constranger alguém por meio de violência ou grave ameaça, causando sofrimento físico ou mental para provocar ação ou omissão de natureza criminosa. 3. Tortura discriminatória ou tortura-racismo: constranger alguém por meio de violência ou grave ameaça, causando sofrimento físico ou mental devido à discriminação racial ou religiosa. 4. Tortura punitiva: submeter alguém, sob sua custódia, poder ou autoridade, por meio de violência ou grave ameaça, a sofrimento físico ou mental intenso como forma de punição pessoal ou medida preventiva. Crime específico. 5. Tortura de prisioneiros ou pessoas sujeitas a medidas de segurança: aplica-se a mesma pena àqueles que submetem um prisioneiro ou pessoa sujeita a medidas de segurança a sofrimento físico ou mental, por meio de ato não previsto em lei ou não resultante de medida legal.
