De acordo com o Código Penal Militar Brasileiro, o procedimento correto para o julgamento de um civil ou um soldado é que o julgamento deve ser realizado em outra audiência dentro de quarenta e oito horas, e o promotor e o defensor terão vinte minutos cada para fazer seus argumentos orais. Após os debates orais, o auditor redigirá a sentença e ordenará que o promotor e o réu ou seu defensor sejam notificados.
