A base legal para a solicitação de justiça gratuita é a alternativa a) Artigo 98 do CPC de 2015 e a Súmula 481 do STJ. O artigo 98 do CPC estabelece que "A pessoa natural ou jurídica, brasileira ou estrangeira, com insuficiência de recursos para pagar as custas, as despesas processuais e os honorários advocatícios tem direito à gratuidade da justiça, na forma da lei".
