Durante o estado de defesa e estado de sítio no Brasil, algumas medidas podem ser tomadas. São elas: Estado de defesa: I - Restrições aos direitos de: a) reunião, ainda que exercida no âmbito das associações; b) sigilo de correspondência; c) sigilo das comunicações telegráficas e telefônicas. II - Ocupação e uso temporário de bens e serviços públicos, no caso de calamidade pública, com a União sendo responsável pelos danos e custos decorrentes. Estado de sítio: I - Obrigatoriedade de permanência em localidade determinada; II - Proibição do direito de reunião; III - Busca e apreensão em domicílios; IV - Intervenção nas empresas que prestam serviços públicos; V - Possibilidade de julgamento por tribunal militar para crimes contra a segurança nacional cometidos por civis; VI - Suspensão da inviolabilidade do domicílio.
