O objetivo do princípio da boa-fé que deve orientar a conduta de todos é proteger a conduta de pessoas maliciosas que buscam tirar proveito de certos sinais conhecidos em determinada linha de negócios sem ter o direito de usar tais sinais. Para que a proibição seja configurada, é necessário que a alternativa correta seja a letra "a": a marca não pode ser desconhecida na linha de negócios do requerente; o titular da marca deve ter sede ou domicílio no território nacional ou em um país com o qual o Brasil mantenha acordo ou que garanta reciprocidade de tratamento; e deve haver afinidade de mercado.
