De acordo com o artigo 60 da Lei nº 9.605/98, quem promove construção em solo não edificável ou suas áreas de proteção permanente, consideradas em razão de sua função ambiental, paisagística, turística, histórica, cultural, arqueológica, etnográfica ou monumental, sem autorização da autoridade competente ou em desacordo com a concedida, está sujeito à pena de detenção de um a três anos e multa.
