Summative Assessments The summative assessments are the major activities designed to assess your skills, knowledge and performance, as required to show competency in this unit. These activities should be completed after finishing the Learner Guide. You should complete these as stated below and as instructed by your trainer/assessor. Skills, knowledge and performance may be termed as: ∙ Skills – skill requirements, required skills, essential skills, foundation skills ∙ Knowledge – knowledge requirements, required knowledge, essential knowledge, knowledge evidence ∙ Performance – evidence requirements, critical aspects of assessment, performance evidence. Section A: Skills Activity ∙ The Skills Activity is designed to be a series of demonstrative tasks that should be assessed by observation (by the assessor or third party, depending on the circumstances). ∙ It will demonstrate all of the skills required for this unit of competency – your assessor will provide further instructions to you, if necessary. Section B: Knowledge Activity (Q & A) ∙ The Knowledge Activity is designed to be a verbal questionnaire where the assessor asks you a series of questions to confirm your competency for all of the required knowledge in the unit of competency. Section C: Performance Activity ∙ The Performance Activity is designed to be a practical activity performed either in the workplace or a simulated environment. You should demonstrate the required practical tasks for the unit of competency and be observed by the assessor and/or third party, as applicable to the situation. If the third party is required to observe you, you will need to make the required arrangements with them. ∙ If necessary for the activities, you should attach completed written answers, portfolios or any evidence of competency to this workbook. D. Observation/Demonstration Throughout this unit, you will be expected to show your competency of the elements through observations or demonstrations. Your trainer/assessor will have a list of demonstrations you must complete or tasks to be observed. The observations and demonstrations will be completed as well as the activities found in this workbook. What you need to submit Answers to the tasks below. Clarify information with your trainer/assessor, if required. Tasks 1. What should be included in a contract? Provide a list of 6 as minimum •An agreement which usually consists of an offer and an acceptance of that offer. •The agreement must have consideration which is something bargained for and given in exchange for a promise. •The parties must have the capacity, or legal ability to contract. •The contract must be based on the genuine assent of each party, that is, both parties must be agreeable to the terms of the contract. •The subject matter of the contract must be legal. An agreement to break the law would be illegal, for example. •Some contracts must be in proper form. Even though courts will enforce an oral contract, some categories of contracts must be in writing to be legal 2. What should be included in a subcontractor agreement? Provide a list of 6 as minimum LICENSING Assume that a contractor is going to hire a subcontractor to handle the installation of a complex electrical system for the client. The contractor needs to make sure that the subcontractor is properly licensed and registered pursuant to state and local laws. The easiest way to do that is to insert a provision into the subcontractor agreement that essentially states that the subcontractor is properly licensed in accordance with all state and local laws and that the subcontractor agrees to defend and indemnify the contractor and others for any damages or legal action arising out of licensing issues. Larger contracting companies may perform a more thorough screening of their subcontractors, which may include licensing and background checks. In today’s litigious society, it simply is not enough to ask if a subcontractor is properly licensed. The subcontractor must acknowledge that it is licensed, in writing, in order to protect the contractor from liability. SCOPE OF WORK AND PAYMENT The job and scope of work that the subcontractor is being hired to perform should be explicitly stated in the subcontract. The scope of work should not be “broad brushed” Instead, it should state, with specificity, the tasks required to be performed by the subcontractor and the due dates, deadlines and other requirements. The more specific the scope of work is, the better. The same holds true for payment options. The subcontract should explicitly state when the subcontractor will get paid. For example, “subcontractor will receive payment once the electrical system is installed, tested and approved by contractor and all punch list items are completed and signed off on by client or contractor.” Make certain to include in the contract any prepayments already made to the contractor. If the payment agreement consists of multiple payments throughout the course of the job, it is a good idea to include a payment table in the subcontract or as an exhibit or addendum to it. TIMING It is very important that the subcontract sets forth all deadlines for the project. It should be as explicit as possible. The subcontract should contain language stating that the subcontractor understands and acknowledges that time is of the essence. Italso should include a provision stating that the subcontractor must inform the contractor immediately if delays are anticipated. DEFENSE AND INDEMNIFICATION Finally, and perhaps most importantly, the subcontract must include a section addressing defense and indemnification of the contractor by the subcontractor. Essentially, the paragraph should state at the very least, “subcontractor, agrees to defend and indemnify the contractor (and others if applicable) against any claims, lawsuits and damages arising out of the subcontractor’s negligence or intentional acts.” It also should include language concerning the subcontractor’s agreement to defend and indemnify the contractor for any misrepresentations, whether made knowingly or unknowingly, including misrepresentations of licensing, corporate status and other relevant issues. A contractor can avoid liability and other unpleasant situations with a wellthought-out subcontractor agreement. Contractors should never be hesitant to tell a subcontractor that refuses to sign the subcontract that their services cannot be utilized. Finally, it is always a good idea to have all contracts, including subcontracts, reviewed by an attorney. 3. Explain the industrial relations rights of subcontractors. ● They are responsible for their own business, including losses and profits. ● They can choose the work they do and have control over how, when and where that work is carried out. ● They are not limited to working for one person or organisation. You agree a fixed price for the job, irrespective of how long the work takes to complete. ● They can hire other people to complete the work. ● They are responsible for fixing mistakes and unsatisfactory work at no additional cost. ● They use their own resources to pay for running costs, materials, equipment and other assets. You are considered their customer or client, rather than their employer 4. Summarise the National Construction Code’s performance benchmarks. The National Construction Code (NCC) is a performance-based code containing Performance Requirements for the design, construction, performance and livability of buildings. To comply with the NCC, a solution must achieve compliance with the Governing Requirements and the Performance Requirements. The Governing Requirements contain requirements about how the Performance Requirements must be met. A building, plumbing or drainage solution will comply with the NCC if it satisfies the Performance Requirements, which are the mandatory requirements of the NCC. Practitioners can develop performance-based solutions to meet the Performance Requirements of the code. This supports innovation by designers and allows them to determine the most effective way for their particular building to demonstrate compliance 5. Summarise the key features of the Construction Occupations (Licensing) Act. The COA Act sets out licensing requirements for construction practitioners who provide, have provided or propose to provide a construction service. A construction service is the doing or supervision of work in a construction occupation which includes builder, building assessor or surveyor, drainer, electrician, gasfitter and plumber. A person, corporation or partnership may apply to be licensed in a construction occupation (including as a builder) or in a class of construction occupations). Corporations and partnerships must have a suitably licensed individual appointed as their nominee for the purpose of supervising the work of the corporation or partnership. The application must be accompanied by information as to the applicant’s fitness, ability and capacity to complete any work to be authorised by the licence. A licensee must have obtained appropriate certificates and have the necessary experience. The precise requirements depend on the class of licence sought by the builder. A licence is granted subject to the conditions contained in the Construction Occupations (Licensing) Regulation 2004 (ACT) and any other conditions imposed by the construction occupations registrar (registrar). 6. Explain the following elements of a performance management system and briefly discuss each: ● Progress report: A progress report is a report in which you are updating information about a project. Progress reports make it possible for management and clients to stay informed about a project and to change or adjust assignments, schedules, and budgets. These types of reports are used for projects that have many steps from onset to completion and are issued at regular intervals. If you are sending your ● Performance review: A performance review is a formal assessment in which a manager evaluates an employee’s work performance, identifies strengths and weaknesses, offers feedback, and sets goals for future performance. Performance reviews are also called performance appraisals or performance evaluations. In the past, many organizations conducted annual performance reviews for their entire workforce; however, more and more companies are moving toward a frequent feedback performance management system in which managers conduct quarterly, monthly, or even weekly reviews. In fact, some organizations are doing away with formal performance reviews altogether in favor of more casual manager check-ins and one-on-ones ● Appeal systems: The appeals process allows a losing party in a trial court decision to have their case re-tried again. Some decisions by federal administrative agencies are also subject to appeals. Both parties are able to appeal in a civil case, but the government is prohibited from appealing not guilty verdicts in criminal cases. However, either party may appeal the sentence issued in the case of a guilty verdict. Bankruptcy appeals in some districts may be handled by a separate appellate committee of bankruptcy judges. ● Disciplinary action: A disciplinary action is a reprimand or corrective action in response to employee misconduct, rule violation, or poor performance. Depending on the severity of the case, a disciplinary action can take different forms, including: A verbal warning, A written warning, A poor performance review or evaluation. Follow your organisational guidelines to appoint subcontractors to satisfy the needs identified in the previous question. The process should be conducted to meet project timelines. 3. Assess the existing appointments process for subcontractors. Identify areas where improvements could be made and implement appropriate changes.
