Sim. O Pacto de São José de Costa Rica foi ratificado pelo Brasil em 1991. Ao
ratificá-lo, o Brasil estaria revogando o antigo Código Civil de 1916 em vigor
com relação à prisão do depositário infiel. A lei posterior revoga lei
anterior. No entanto, o Tratado conflitava com a Constituição Federal. Foi
então criado o § 3º do <span class=SpellE>art</span> 5º da CF, através da EC/45.

um tratado de proteção ao meio ambiente entre 30 Estados numa Conferência
realizada no Japão. O texto elaborado foi aprovado por um <i>quorum</i> de 3/5
dos presentes, como decido pelos Estados e expresso em cláusula incluída no
texto. Em fase de assinatura, apenas 10 Estados assinaram o compromisso
internacional por seus plenipotenciários habilitados, <span class=GramE>5</span>
apenas o rubricaram e os outros 15, manifestaram seu consentimento por
representantes sem carta de plenos poderes. Decidiram os Estados pela
prorrogação da fase de assinatura por 30 dias, ao fim dos quais o acordo
deveria ser ratificado. Passados os 30 dias, as manifestações expressas por
rubrica foram confirmadas, mas os Estados cujos representantes não portavam
cartas de plenos poderes não apresentaram o exigido documento. O tratado foi
ratificado pelos 30 Estados. Um Estado Y, que assinou e ratificou o acordo vai
à Corte Internacional de Justiça pleitear a exclusão dos <span class=GramE>5</span>
Estados que não apresentaram carta de plenos poderes, alegando que não houve a
assinatura e assim o tratado não teria efeitos com relação a eles. Procede a
