De acordo com o ordenamento jurídico brasileiro, a ação de reconhecimento de filiação é um direito que não é restrito pelo sistema legal brasileiro, pois é um direito incontestável. O sistema legal brasileiro reconhece a imprescritibilidade da ação de reconhecimento de filiação, conforme estabelecido no artigo 1.606 do Código Civil. De acordo com a jurisprudência, o direito à filiação é um direito humano fundamental, reconhecido constitucionalmente e integrado à dignidade da pessoa humana, um princípio básico da República Federativa do Brasil.
