A competência do Poder Judiciário, de acordo com a Constituição Brasileira, é a de julgar e decidir conflitos de interesses entre pessoas físicas ou jurídicas, bem como garantir o cumprimento das leis e da Constituição. O Poder Judiciário tem o monopólio da jurisdição no Brasil, o que significa que mesmo que haja decisões tomadas na esfera dos outros poderes ou órgãos constitucionais autônomos (Ministério Público e Tribunais de Contas), tais decisões nunca terão o poder de fazer coisa julgada impedindo sua apreciação pelo Judiciário.
