Requirements of Arrependimento Posterior
Arrependimento Posterior is a cause for mandatory reduction of sentence, applicable to crimes committed without violence or serious threat to a person, in which the agent, by voluntary act, repairs the damage or returns the thing before the receipt of the complaint.
The act of repairing the damage or returning the thing must be voluntary.
The benefit of Arrependimento Posterior does not extend to the co-author or participant who has not voluntarily made the reimbursement.
The payment of a check without funds before the receipt of the complaint extinguishes the punishment, however, if made after the receipt, the criminal action continues.
The agent is responsible for the crime committed, with a reduction in sentence from 1/3 to 2/3.

O Arrependimento Posterior é uma causa de redução obrigatória da pena, aplicável a crimes cometidos sem violência ou grave ameaça à pessoa, em que o agente, por ato voluntário, repara o dano ou restitui a coisa antes do recebimento da denúncia. Os requisitos para a aplicação do Arrependimento Posterior são: - Crime cometido sem violência ou grave ameaça à pessoa; - Reparação voluntária do dano ou restituição da coisa antes do recebimento da denúncia; - Ato voluntário do agente. O benefício do Arrependimento Posterior não se estende ao coautor ou partícipe que não tenha feito voluntariamente a reparação. O pagamento de cheque sem fundos antes do recebimento da denúncia extingue a punibilidade, porém, se feito após o recebimento, a ação penal continua. O agente é responsável pelo crime cometido, com uma redução de pena de 1/3 a 2/3.
