A Convenção Americana sobre Direitos Humanos, também conhecida como Pacto de San José da Costa Rica, foi incorporada ao ordenamento jurídico brasileiro em 1992, por meio do Decreto nº 678/1992. Dessa forma, a Convenção tem status de norma constitucional, ou seja, possui hierarquia superior às leis ordinárias e inferiores apenas à Constituição Federal. Além disso, a Convenção é considerada uma cláusula pétrea, ou seja, não pode ser objeto de emenda constitucional que a suprima ou diminua sua eficácia.
