style='font-weight:normal'>Caso – Num sábado à noite um cidadão recebe a visita
de um Oficial de Justiça que havia se dirigido até sua residência com o fim de
citar sua esposa, que se encontrava enferma e acamada.</span></strong></p>
<p class=MsoNoSpacing style='text-align:justify'><strong><span
style='font-weight:normal'>Preocupado com o estado de saúde de sua mulher, o
cidadão não permitiu a entrada do Oficialde Justiça em sua casa, e quando este
tentou ingressar forçosamente, foi repelido com um empurrão.</span></strong></p>
<p class=MsoNoSpacing style='text-align:justify'><strong><span
style='font-weight:normal'>Foi o cidadão então indiciado pelo crime de
desobediência (art. 330, Código Penal). O Juiz de primeira instância o
absolveu, entendendo ter o agente agido com inexigibilidade de conduta diversa,
em face do exposto no art. 5º, XI da Constituição da República.</span></strong></p>
<p class=MsoNoSpacing style='text-align:justify'><strong><span
style='font-weight:normal'>No entanto, provendo apelo do Ministério Público, o
Tribunal de Justiça reformou a decisão de primeiro grau, entendendo que o autor
atuou com violência contra agente público competente que executava ordem com
amparo legal. Ressaltou o Tribunal que o Oficial de Justiça encontrava-se de
posse de mandado de citação que continha autorização expressa para cumprimento
em domingo ou em dia útil, em horário diverso do estabelecido no caput do art.
172 do Código de Processo Civil, nos termos do § 2º deste mesmo artigo,
condenando-o assim nas penas do crime de desobediência.</span></strong></p>
<p class=MsoNoSpacing style='text-align:justify'><strong><span
style='font-weight:normal'>Dessa decisão do Tribunal de Justiça o advogado
interpôs Recurso Extraordinário, pedindo a reforma da decisão do TJ com o
restabelecimento da sentença de 1º grau. Analise tecnicamente as possibilidades
de sucesso desse recurso, conforme a jurisprudência do Supremo Tribunal

absolvido agente que, ao defender a inviolabilidade noturna do domicílio,
acabou não atendendo oficial de justiça num sábado à noite, que pretendia
proceder à intimação do seu cônjuge.<br>

da CF (<span class=GramE>"a</span> casa é asilo inviolável do indivíduo,
ninguém nela podendo penetrar sem consentimento do morador, salvo em caso de
flagrante delito ou desastre, ou para prestar socorro, ou, durante o dia, por
determinação judicial;"), a Turma deu provimento a recurso extraordinário
para, reformando acórdão do Tribunal de Justiça do Estado do Rio Grande do Sul,
restabelecer a sentença que absolvera o recorrente por inexigibilidade de
conduta diversa. No caso, a Corte a quo reputara configurado o crime de
resistência, uma vez que o recorrente, desprezando a existência de mandado
judicial expedido nos moldes do § 2º do art. 172 do CPC — que permite, em
situações excepcionais e mediante autorização expressa do juiz, a citação, em
domingos e feriados, ou nos dias úteis, em horário diverso daquele estabelecido
no caput —, desacatara, mediante violência, oficial de justiça que pretendia,
num sábado à noite, ingressar no domicílio daquele para intimar o seu cônjuge.
Aduziu-se que o acórdão impugnado colocara em plano secundário a defesa do
próprio domicílio e, portanto, o esforço a evidenciar, conforme registrado na
sentença, a inexigibilidade de conduta diversa. Ademais, asseverou-se que a
Constituição preconiza a inviolabilidade noturna do domicílio, pouco importando
a existência de ordem judicial (...)".<o:p></o:p></span></p>
