O conteúdo do artigo 388 do Código de Processo Penal Militar é o seguinte: I - As sessões e atos processuais podem ser realizados fora da sede da Auditoria, em local especialmente designado pelo auditor, com as partes sendo notificadas para esse fim. II - Se o acusado se comportar de maneira inconveniente durante a sessão, ele será advertido pelo presidente do Conselho; e, se persistir, poderá ser retirado da sessão, que continuará sem sua presença, porém, com seu advogado ou curador. Caso algum deles se recuse a permanecer na sala, o presidente nomeará um advogado de defesa ou curador ad hoc para o acusado, para atuar até o final da sessão. O auditor procederá da mesma forma, no caso de ato de sua competência. III - Em caso de desrespeito ao juiz, ao promotor ou ao escrivão, o presidente do Conselho ou o auditor determinará a lavratura do auto de flagrante delito, que será encaminhado à autoridade judicial competente.
