O crime de furto, de acordo com o artigo 155 do Código Penal Brasileiro, é definido como a ação de subtrair, para si ou para outrem, coisa móvel alheia. A pena é aumentada em um terço se o crime é cometido durante o repouso noturno. Se o criminoso é primário e o objeto roubado é de pequeno valor, o juiz pode substituir a pena de prisão por detenção, reduzi-la de um a dois terços ou aplicar apenas uma multa. O objeto do crime é qualquer coisa móvel pertencente a outra pessoa.
