A classificação que a doutrina jurídica construiu para os direitos humanos, de acordo com a ordem histórica e cronológica em que esses direitos começaram a ser reconhecidos constitucionalmente, são as gerações de direitos. São elas: 1ª geração: correspondem aos direitos individuais e políticos clássicos e garantias, institucionalmente surgidos a partir da Magna Carta. 2ª geração: também chamados de direitos meta-individuais, coletivos ou difusos, que incluem direitos sociais, direitos relacionados à saúde, educação, segurança social e assistência, lazer, trabalho, segurança e transporte. 3ª geração: chamados de direitos de solidariedade ou fraternidade; resultado de lutas sociais e transformações sócio-político-econômicas que ocorreram nos últimos 3 séculos da história humana e que resultaram em conquistas sociais e democráticas. Eles abrangem o direito a um ambiente equilibrado, proteção do consumidor, paz, progresso e autodeterminação dos povos.
