Competence to judge appeals against decisions of the Military Justice Courts and the Military Justice Federal Judges;
Competence to judge conflicts of jurisdiction between Justice Councils, between federal judges of Military Justice, or between these and those, as well as conflicts of attribution between military administrative and judicial authorities;
Competence to create and extinguish positions and to fix the salaries of its members, the Auxiliary Corregidor Judge, the federal judges of Military Justice, the federal substitute judges of Military Justice and the auxiliary services;
Competence to grant leave, vacations, and other absences to its members, the Auxiliary Corregidor Judge, the federal judges of Military Justice, the federal substitute judges of Military Justice, and the servers who are immediately linked to the Superior Military Court;
Competence to appoint a federal substitute judge of Military Justice and to promote him by alternating criteria of seniority and merit;
Competence to remove a federal judge of Military Justice and a federal substitute judge of Military Justice, at the request or for reasons of public interest;
Competence to designate, observing the order of seniority, a federal judge of Military Justice to exercise the function of forum director, and to define his/her attributions;
Competence to sign with the Secretary of the Full Court the minutes of the sessions;
Competence to give possession and defer the legal commitment to the federal substitute judge of Military Justice and to all those appointed to positions in commission;
Competence to designate, observing the order of seniority, a federal judge of Military Justice to exercise the function of forum director, and to define his/her attributions;
Competence to judge military crimes committed by officers and equivalent, and to judge appeals against decisions of the Military Justice Courts and the Military Justice Federal Judges;
Competence to judge military crimes committed by non-officers, in the cases referred to in item I of this article;
Competence to process and judge military crimes committed outside the national territory, observed the provisions of the Military Penal Procedure Code regarding the competence by the place of the infraction.

De acordo com a Lei 13.774/2018, as competências do Superior Tribunal Militar são: - Julgar recursos contra decisões dos Tribunais de Justiça Militar e dos Juízes de Direito da Justiça Militar; - Julgar conflitos de jurisdição entre Conselhos de Justiça, entre juízes federais da Justiça Militar ou entre estes e aqueles, bem como conflitos de atribuição entre autoridades administrativas e judiciais militares; - Criar e extinguir cargos e fixar os vencimentos de seus membros, do Juiz Corregedor Auxiliar, dos juízes federais da Justiça Militar, dos juízes federais substitutos da Justiça Militar e dos serviços auxiliares; - Conceder licenças, férias e outros afastamentos a seus membros, ao Juiz Corregedor Auxiliar, aos juízes federais da Justiça Militar, aos juízes federais substitutos da Justiça Militar e aos servidores que lhe são imediatamente vinculados; - Nomear juiz federal substituto da Justiça Militar e promovê-lo por critérios alternados de antiguidade e merecimento; - Exonerar juiz federal da Justiça Militar e juiz federal substituto da Justiça Militar, a pedido ou por motivo de interesse público; - Designar, observada a ordem de antiguidade, juiz federal da Justiça Militar para exercer a função de diretor do foro, e definir suas atribuições; - Assinar com o Secretário do Plenário as atas das sessões; - Dar posse e deferir o compromisso legal ao juiz federal substituto da Justiça Militar e a todos os nomeados para cargos em comissão; - Julgar crimes militares cometidos por oficiais e equivalentes, e julgar recursos contra decisões dos Tribunais de Justiça Militar e dos Juízes de Direito da Justiça Militar; - Julgar crimes militares cometidos por não-oficiais, nos casos referidos no item I deste artigo; - Processar e julgar crimes militares cometidos fora do território nacional, observadas as disposições do Código de Processo Penal Militar quanto à competência pelo lugar da infração.
