De acordo com a Lei 13.846/2019, as novas regras para concessão do auxílio-doença são as seguintes:

a) O segurado que já é portador da doença ou lesão invocada como causa para o benefício não terá direito ao auxílio-doença, exceto quando a incapacidade decorrer da progressão ou agravamento da doença ou lesão.
b) O auxílio-doença não será devido ao segurado em regime de prisão fechado.
c) O segurado que estiver recebendo o auxílio-doença na data da prisão terá o benefício suspenso.
d) As novas regras serão aplicadas retroativamente a todos os segurados.
