(Adapted from ENADE, 2019) The Supreme Court defined, in 2009, the criteria for the recognition of a certain land as indigenous territory, being: the marker of the traditional nature of the occupation; the temporal marker of the occupation; the marker of the concrete scope and practical purpose of traditional occupation; and, finally, the marker of proportionality, which consists of applying the principle of proportionality in indigenous matters. According to the marker of the traditional nature of the occupation, for an indigenous land to be considered traditional, indigenous communities must demonstrate the character of durability of their relationship with the land, a character demonstrated in the sense of ethnographic continuity.
