a) The interpretation of the art. 223-A of the CLT would result in unfair discriminatory treatment of people inserted in the labor relationship, with unconstitutionality by offense to arts. 1, III; 3, IV; 5, caput and items V and X, and 7, caput, all of the Federal Constitution.
b) The new art. 223-B of the CLT intends to exclude from the appreciation of the Labor Court both moral damage and non-pecuniary damage arising from the employment relationship.
c) The sphere of the moral of human beings is the content of human dignity value (art. 1, III, of the Federal Constitution) and, as such, cannot suffer restriction to ample and integral reparation when violated, being the duty of the State the respective protection in the occurrence of illicit acts causing non-pecuniary damages in labor relations.
