A afirmação do advogado de ENÉAS está incorreta. O artigo 450 do Código Civil estabelece que, além das custas, a parte responsável pelo despejo (vendedor) também deve ser responsável pela indenização pelos frutos que a pessoa despejada foi obrigada a devolver, bem como pela indenização pelos gastos dos contratos e danos que resultam diretamente do despejo. Portanto, a responsabilidade civil pela ocorrência do despejo não se limita apenas às custas judiciais e honorários advocatícios.
